Ripple SEC Lawsuit– Ripple’s recent attempt to dismiss the long-running SEC lawsuit has been met with doubt from legal experts. Some commentators describe the filing as a “rare whiff” by Ripple’s legal team, suggesting it is unlikely to succeed.

The SEC’s case against Ripple, a defining enforcement action during Gary Gensler’s tenure, continues to unfold. Although the SEC dropped parts of its lawsuit in March, unresolved issues keep the two parties returning to court. Most recently, they appeared before Judge Torres, who previously rejected Ripple’s joint filing with the SEC in May. This forced both sides to rush to meet a June 16 deadline for a new proposal.

Proposed Deal Cites ‘Exceptional Circumstances’

Ripple and the SEC’s latest motion argues that “exceptional circumstances,” including the SEC’s changing stance on cryptocurrency policy, justify revisiting previous rulings. The central question remains whether the SEC should prohibit Ripple from selling securities. While financial penalties are involved, the core focus is on the regulatory ban.

Fred Rispoli, a trial lawyer specializing in crypto cases, criticized the filing as insufficient and lacking depth: “I don’t like this filing based on how obvious it was from Judge Torres’ last ruling that she was pissed. I recommended a long, detailed motion explaining the SEC’s failures… Instead, we got one paragraph on other SEC dismissals and a paltry mention of the SEC Crypto Task Force.”
