OpenSea– The United States Securities and Exchange Commission (SEC) has wrapped up its investigation into the NFT marketplace OpenSea, according to its founder Devin Finzer. In a Feb. 21 post on X, Finzer celebrated the news, saying, “The SEC is closing its investigation into OpenSea. This is a win for everyone who is creating and building in our space.”

The SEC’s decision to close the investigation came shortly after it agreed to drop its lawsuit against cryptocurrency exchange Coinbase, which accused the platform of acting as an unregistered securities broker. OpenSea’s founder expressed relief, noting that labeling NFTs as securities could have negatively impacted the industry, hindering its growth and innovation.

This conclusion marks a significant moment for the NFT space, which had been under scrutiny for the past few months. The SEC investigation, launched in August 2024, followed a Wells notice alleging that OpenSea had been facilitating the exchange of unregistered securities.

Wider Industry Applauds the Outcome

The news has been met with positive reactions across the industry. Magic Eden’s Chief Business Officer, Chris Akhavan, acknowledged the outcome as a “win for the entire industry,” even though Magic Eden competes with. “While we are competitors in the trenches, we share a deep belief in NFTs and what they will enable,” Akhavan stated in a post. “Happy to see such a win for the space.”

The sentiment was echoed by Beanie, an NFT space figure, who praised OpenSea’s efforts for providing regulatory clarity in the space. He noted that, despite the challenges, had made a significant contribution to the NFT industry.
