The White House has clarified that billionaire Elon Musk is not officially part of the Department of Government Efficiency (DOGE) team currently reviewing federal agencies. Instead, he serves as a senior adviser to President Donald Trump, a distinction that could play a pivotal role in an ongoing legal dispute over the team’s access to government data.

At the heart of the controversy is whether Musk holds too much influence in the administration’s efforts to downsize the federal workforce. By defining him as an adviser rather than an official administrator overseeing DOGE’s daily operations, the White House aims to counter lawsuits that claim Musk wields excessive power without an electoral mandate or Senate confirmation.

The Trump administration is currently defending itself against legal challenges from several Democratic-led states seeking to block Musk and the DOGE team from accessing government systems. The lawsuits argue that Musk exercises “virtually unchecked power” in violation of constitutional principles. However, the White House maintains that Musk is not an employee of DOGE and lacks the authority to make unilateral government decisions.

In court documents filed Monday, Joshua Fisher, director of the White House Office of Administration, stated that Musk has “no actual authority to make government decisions himself.” The filings did not disclose who is officially leading DOGE, despite Musk publicly endorsing its work on his social media platform X and during a White House event.

During a press briefing on Tuesday, White House Press Secretary Karoline Leavitt declined to name the DOGE administrator but had earlier told Fox News that Musk was “tasked with overseeing the effort on behalf of the president.” She emphasized that any layoffs resulting from the initiative would be determined by individual agency heads. “Elon Musk, just like everyone else in the federal government, operates under the direction of President Trump,” Leavitt said.

The DOGE team has been actively examining federal agencies, reviewing budgets, accessing government computer systems, and searching for inefficiencies, all while facing mounting legal challenges. At least two lawsuits specifically target Musk.

The controversy intensified last week when Musk called for the elimination of entire federal agencies as part of a broader effort to cut spending and restructure government priorities.

During a court hearing on Monday, U.S. District Judge Tanya Chutkan appeared skeptical of the Justice Department’s argument that Musk lacks formal authority. “I think you stretch too far. I disagree with you there,” Chutkan remarked, signaling that the legal battle over Musk’s role is far from over.
