Who is Dan Gallagher? Could He Replace SEC Chair Gary Gensler if Trump Returns to Power?
Amid growing focus on Donald Trump and the remaining presidential candidates, attention has recently shifted to Dan Gallagher, a potential replacement for current SEC Chair Gary Gensler. Over the years, the U.S. Securities and Exchange Commission (SEC) has adopted a hardline stance toward the crypto industry, a move that has drawn significant criticism.
If Trump wins the election, Gensler’s position could be at risk, as the former president has publicly stated his intention to fire Gensler during a rally. However, even if Trump fails to secure victory, rumors persist that Gensler might soon be ousted, fueling curiosity about who could take his place.
Who is Dan Gallagher?
Dan M. Gallagher is a prominent figure within the financial and cryptocurrency sectors, currently serving as the Chief Legal Officer (CLO) of Robinhood, one of the most widely used investment platforms. Speculation surrounding Gallagher’s potential elevation to SEC Chair has garnered increased attention, particularly among critics of Gary Gensler’s policies. Over the years, the SEC has imposed strict regulations on the crypto space, and many believe this has stifled the industry’s growth.
Gallagher, 52, is an experienced American lawyer who previously served as one of the five commissioners of the SEC. Appointed by President Barack Obama in 2011, he held this position until 2015. His background also includes roles as a deputy director and co-acting director of the SEC’s Division of Trading and Markets. In addition to his government experience, Gallagher has held advisory positions in academia, notably at the Institute for Law and Economics at the University of Pennsylvania. Gallagher’s diverse career trajectory, with stints in both the public and private sectors, has led some to view him as a more favorable replacement for Gensler.
Gallagher himself has been critical of Gensler’s regulatory approach. In a recent interview, he expressed respect for Gensler but noted that he would have taken a different approach, particularly when it comes to the crypto industry. Gallagher advocated for more customized regulations and a baseline registration system for crypto exchanges and brokers.
Could Dan Gallagher Become the Next SEC Chair?
Donald Trump’s public promise to dismiss Gensler if re-elected has created uncertainty around the current SEC Chair’s future. Trump, during a rally, admitted that he had not been fully aware of Gensler’s unpopularity. Many political observers and netizens believe that Gallagher’s views align more closely with Trump’s administration, fueling speculation that Gallagher could be tapped to lead the SEC. However, these rumors remain unsubstantiated for now.
The speculation around Gallagher’s potential nomination began after Politico reported on several candidates being considered for the role, with Gallagher being mentioned as a top contender. A former SEC official was quoted in the report, calling Gallagher a “natural choice” and citing several other factors that could favor his selection.
However, there is one notable concern: Robinhood’s ongoing legal battles with the SEC could complicate Gallagher’s path to the Chair position. Moreover, Gallagher has not publicly expressed any immediate plans to leave Robinhood for the SEC. He has, however, acknowledged the rumors and expressed appreciation for the recognition, while hoping the best candidate ultimately secures the role.
In addition to Gallagher, other potential candidates have been mentioned, including Christopher Giancarlo (nicknamed “CryptoDad”), Robert Stebbins, and several others from K Street.
While Gallagher’s nomination is far from certain, the growing speculation about his potential leadership of the SEC reflects the broader frustration with Gensler’s tenure, particularly among those in the cryptocurrency space.
