SEC personnel met with representatives of at least seven firms on December 21, and an earlier report states that the applicants were given until December 29 to file their final S-1 modifications. A first wave of prospective spot Bitcoin ETF approvals in early January will not include any issuer who misses the deadline, according to information provided by regulators to attendees of the meetings.
An amendment to the S-1 registration statement for Ark 21Shares Bitcoin ETF was filed by ARK Invest late on December 28, according to a filing with the SEC. Authorized participants were the main focus of the modification, according to Eric Balchunas, an analyst with Bloomberg ETF.
Companies are Waiting to Gain Advantage Against Their Competitors
With further revised S-1 filings anticipated in the next 24 hours, over a dozen companies are competing for approval of a spot Bitcoin exchange-traded fund. James Seyffart, a fellow Bloomberg ETF analyst, had earlier expressed surprise at not having seen any updated Bitcoin ETF filings. Balchunas remarked that some would wait until the very last minute in order to avoid disclosing the changes to their rivals.
